合肥市业主大会和业主委员会指导规则

line-height: 23pt;"><span style="font-family: 宋体; font-size: medium;"><strong>第一条 </strong><span style="color: #262626;">为规范业主大会、业主委员会的成立及活动,维护业主的合法权益,指导全体业主正确行使共同管理权利,根据《中华人民共和国物权法》、国务院《物业管理条例》、《安徽省物业管理条例》、《合肥市物业管理若干规定》及有关规定,结合本市实际制定本规则。<span lang="EN-US"></span></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-family: 宋体; font-size: medium;"><strong><span style="color: #262626;">第二条 </span></strong><span style="color: #262626;">本市行政区域内业主大会的成立和召开、业主委员会的选举及活动适用本规则。</span><strong><span lang="EN-US"></span></strong></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-family: 宋体; font-size: medium;"><strong><span style="color: #262626;">第三条</span></strong><span style="color: #262626;"> 业主大会是由物业管理区域内的全体业主组成,代表和维护物业管理区域全体业主在物业管理活动中的合法权利,履行相应的义务。<span lang="EN-US"></span></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-family: 宋体; font-size: medium;"><strong><span style="color: #262626;">第四条 </span></strong><span style="color: #262626;">业主大会、业主委员会应当依据法律、法规、规章的规定和管理规约、业主大会议事规则的约定行使合法权利、履行相应义务。<span lang="EN-US"></span></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-family: 宋体; font-size: medium;"><strong><span style="color: #262626;">第五条</span></strong><span style="color: #262626;"> 业主大会或者业主委员会的决定,对全体业主具有约束力。<span lang="EN-US"></span></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-size: medium; font-family: 宋体; color: #262626;">业主大会和业主委员会,对业主损害他人合法权益和业主共同利益的行为,有权依照法律、法规以及管理规约,要求停止侵害、消除危险、排除妨碍、赔偿损失。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-family: 宋体; font-size: medium;"><strong><span style="color: #262626;">第六条 </span></strong>街道办事处、乡镇人民政府在县(市)、区(开发区)物业管理行政主管部门指导下,负责组织协调本辖区业主大会成立和业主委员会换届工作,协调物业管理与社区管理、社区服务的关系,调解业主、业主委员会与物业服务企业之间的物业管理纠纷,其中,涉及重大纠纷的,由市、县(市)、区房地产行政主管部门负责调解。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-size: medium; font-family: 宋体; color: #262626;">居(村)民委员会应当协助街道办事处、乡镇人民政府做好相关工作。</span></p> <p class="MsoNormal" style="text-align: center; text-indent: 27.75pt; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-family: 宋体; font-size: medium;"><strong><span style="color: #262626;">第二章 业主大会</span></strong></span></p> <p class="MsoNormal" style="text-indent: 14.0pt; mso-char-indent-count: 1.0; line-height: 23.0pt; mso-line-height-rule: exactly; text-autospace: ideograph-other;"><span style="font-family: 宋体; font-size: medium;"><strong><span lang="EN-US">&nbsp; </span></strong><strong>第七条 </strong>符合下列条件之一的,应当召开首次业主大会会议:<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 14.0pt; mso-char-indent-count: 1.0; line-height: 23.0pt; mso-line-height-rule: exactly; text-autospace: ideograph-other;"><span style="font-family: 宋体; font-size: medium;"><span lang="EN-US">&nbsp;</span>(一)入住率达到<span lang="EN-US">50%</span>以上的;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 14.0pt; mso-char-indent-count: 1.0; line-height: 23.0pt; mso-line-height-rule: exactly; text-autospace: ideograph-other;"><span style="font-family: 宋体; font-size: medium;"><span lang="EN-US">&nbsp;</span>(二)首批物业交付满二年,并且入住率超过<span lang="EN-US">30%</span>的;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 21.0pt; mso-char-indent-count: 1.5; line-height: 23.0pt; mso-line-height-rule: exactly; tab-stops: 10.5pt; text-autospace: ideograph-other;"><span style="font-size: medium; font-family: 宋体;">(三)首批物业交付满三年的。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 14.0pt; mso-char-indent-count: 1.0; line-height: 23.0pt; mso-line-height-rule: exactly; text-autospace: ideograph-other;"><span style="font-family: 宋体; font-size: medium;"><span lang="EN-US">&nbsp;</span>符合首次业主大会会议召开条件之一,建设单位、<span lang="EN-US">20%</span>以上业主或者前期物业服务企业可以书面向物业所在地街道办事处、乡镇人民政府申请成立业主大会。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.7pt; mso-char-indent-count: 1.98; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-family: 宋体; font-size: medium;">分期开发的建设项目,首次业主大会会议应当根据分期开发的物业面积和进度等因素,在业主大会议事规则中明确增补业主委员会委员的办法。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.7pt; mso-char-indent-count: 1.98; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-family: 宋体; font-size: medium;"><strong>第八条</strong><strong> </strong>业主大会根据物业管理区域的划分成立,一个物业管理区域成立一个业主大会。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 14.0pt; mso-char-indent-count: 1.0; line-height: 23.0pt; mso-line-height-rule: exactly; text-autospace: ideograph-other;"><span style="font-family: 宋体; font-size: medium;"><span lang="EN-US">&nbsp;</span><strong>第九条 </strong>街道办事处、乡镇人民政府应当自接到成立业主大会申请之日起<span lang="EN-US">45</span>日内,成立首次业主大会会议筹备组,并指定专人担任首次业主大会会议筹备组组长<strong>。</strong><span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-family: 宋体; font-size: medium;"><strong>第十条 </strong>筹备组由业主代表、建设单位代表、街道(乡镇)和居(村)民委员会代表组成。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-size: medium; font-family: 宋体;">业主代表应当具有业主身份、具有完全民事行为能力、责任心强、模范履行业主义务、具备必要的工作时间。业主代表由街道办事处、乡镇人民政府或居(村)民委员会组织业主推荐。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-size: medium; font-family: 宋体;">筹备组成员人数应为单数,其中非建设单位的业主代表人数不得低于筹备组总人数的一半。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-family: 宋体; font-size: medium;"><strong>第十一条 </strong>筹备组应当自成立之日起<span lang="EN-US">15</span>日内将最终确定的筹备组成员名单、分工、联系方式等在物业管理区域内显著位置公告,筹备组自公告之日起成立。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-size: medium; font-family: 宋体;">业主(<span lang="EN-US">20%</span>以上)对筹备组成员有异议的,由街道办事处、乡镇人民政府协调解决。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-size: medium; font-family: 宋体;">建设单位和前期物业服务企业应当配合筹备组开展工作。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-family: 宋体; font-size: medium;"><strong>第十二条 </strong>建设单位或前期物业服务企业必须自筹备组成立之日起<span lang="EN-US">7</span>日内向筹备组提供筹备首次业主大会会议所需的下列文件资料,并承担筹备召开首次业主大会会议所必需费用。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-size: medium; font-family: 宋体;">(一)物业管理区域证明;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-size: medium; font-family: 宋体;">(二)房屋及建筑物面积清册;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-size: medium; font-family: 宋体;">(三)业主名册;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-size: medium; font-family: 宋体;">(四)建筑规划总平面图;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-size: medium; font-family: 宋体;">(五)交付使用公用设施设备的证明;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-size: medium; font-family: 宋体;">(六)物业服务用房配置证明;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-size: medium; font-family: 宋体;">(七)其他有关的文件资料。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-size: medium; font-family: 宋体;">筹备组应当对业主资料保密,不得将前款资料用于与筹备无关的活动。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-family: 宋体; font-size: medium;"><strong>第十三条 </strong>筹备组负责首次业主大会会议筹备工作,履行下列职责:<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-size: medium; font-family: 宋体;">(一)确定首次业主大会会议召开方案,会议召开的时间、地点、形式、议题及表决规则;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-size: medium; font-family: 宋体;">(二)草拟管理规约、业主大会议事规则、业主委员会工作规则;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-size: medium; font-family: 宋体;">(三)确认业主身份及业主在首次业主大会会议上的表决权数;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-size: medium; font-family: 宋体;">(四)提出首届业主委员会委员选举办法、候选人条件和名单;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-size: medium; font-family: 宋体;">(五)召开首次业主大会会议的其他筹备工作。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.75pt; line-height: 23pt;"><span style="font-size: medium; font-family: 宋体;">对前款规定的内容,业主大会筹备组应当在首次业主大会会议召开<span lang="EN-US">15</span>日前,在物业管理区域内公告,并将公告时间、地点书面(或以其他方式)通知全体业主。业主对业主身份、投票权数和管理规约、业主大会议事规则、业主委员会工作规则草案等提出异议的,筹备组应当予以复核或者修改,并告知异议人。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.7pt; mso-char-indent-count: 1.98; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-family: 宋体; font-size: medium;"><strong>第十四条 </strong>筹备组应当遵守以下工作原则:<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.7pt; mso-char-indent-count: 1.98; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-size: medium; font-family: 宋体;">(一<span style="letter-spacing: -1.0pt;">)筹</span>备组组长负责召集和主持筹备组会议;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.7pt; mso-char-indent-count: 1.98; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-size: medium; font-family: 宋体;">(二)筹备组作出决定应当经筹备组过半数成员同意;成员进行表决时应当在决议上签字,注明同意、反对或者弃权。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.7pt; mso-char-indent-count: 1.98; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-size: medium; font-family: 宋体;">(三)筹备组应当对会议进行书面记录,筹备组组长应当对表决及会议记录予以签字确认;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.7pt; mso-char-indent-count: 1.98; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-size: medium; font-family: 宋体;">(四)筹备组的业主代表不能委托代理人参加会议;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.7pt; mso-char-indent-count: 1.98; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-size: medium; font-family: 宋体;">(五)筹备组应当自成立之日起<span lang="EN-US">90</span>日内完成筹备工作,组织召开首次业主大会会议。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 30.0pt; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-family: 宋体; font-size: medium;"><strong>第十五条 </strong>首次业主大会会议应当对以下事项进行表决,并应当经专有部分面积占建筑物总面积过半数的业主且占总人数过半数的业主同意:<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 30.0pt; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-size: medium; font-family: 宋体;">(一)管理规约;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 30.0pt; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-size: medium; font-family: 宋体;">(二)业主大会议事规则;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 30.0pt; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-size: medium; font-family: 宋体;">(三)业主委员会委员、候补委员名单。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 30.0pt; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-size: medium; font-family: 宋体;">业主大会自对以上事项表决通过之日起成立。筹备组应当自首次业主大会会议作出决定通过之日起<span lang="EN-US">3</span>日内,将表决结果在物业管理区域内显著位置公告,公告时间不少于<span lang="EN-US">7</span>日。筹备组自公告之日起职责终止。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 30.0pt; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-family: 宋体; font-size: medium;"><strong>第十六条 </strong>业主大会决定以下事项:<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 30.0pt; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-family: 宋体; font-size: medium;">(一)制定、修改管理规约、业主大会议事规则;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 30.0pt; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-family: 宋体; font-size: medium;">(二)选举或者更换业主委员会委员;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 30.0pt; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-family: 宋体; font-size: medium;">(三)确定或者变更物业管理方式、服务事项、服务标准和收费方案;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 30.0pt; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-family: 宋体; font-size: medium;">(四)选聘、解聘物业服务企业或者不再接受物业服务企业事实服务;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 30.0pt; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-family: 宋体; font-size: medium;">(五)筹集和使用专项维修资金;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 30.0pt; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-family: 宋体; font-size: medium;">(六)申请改建、重建建筑物及附属设施;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 30.0pt; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-family: 宋体; font-size: medium;">(七)改变共用部分用途;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 30.0pt; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-family: 宋体; font-size: medium;">(八)利用共用部分进行经营以及所得收益的分配、使用与管理;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 30.0pt; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-family: 宋体; font-size: medium;">(九)对业主违反物业管理相关规定的行为,向人民法院提起诉讼;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 30.0pt; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-family: 宋体; font-size: medium;">(十)决定物业管理区域内的其他重大物业管理事项。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 30.0pt; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-family: 宋体; font-size: medium;">决定第(五)项事项,应当经专项维修资金列支范围内专有部分占建筑物总面积三分之二以上的业主且占总人数三分之二以上的业主同意;决定第(六)项事项,应当经专有部分占建筑物总面积三分之二以上的业主且占总人数三分之二以上的业主同意;决定其他事项,应当经专有部分占建筑物总面积过半数的业主且占总人数过半数的业主同意。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.7pt; mso-char-indent-count: 1.98; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-family: 宋体; font-size: medium;"><strong>第十七条 </strong>业主的表决权按照面积和人数计算。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.7pt; mso-char-indent-count: 1.98; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-size: medium; font-family: 宋体;">业主的面积表决权数按照下列方法认定:<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.7pt; mso-char-indent-count: 1.98; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-size: medium; font-family: 宋体;">(一)专有部分面积,按照不动产登记簿记载的面积计算;尚未进行物权登记的,暂按测绘机构的实测面积计算;尚未进行实测的,暂按房屋买卖合同记载的面积计算;<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.7pt; mso-char-indent-count: 1.98; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-size: medium; font-family: 宋体;">(二)建筑物总面积,按照前项的统计总和计算。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.7pt; mso-char-indent-count: 1.98; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-size: medium; font-family: 宋体;">业主的人数表决权数按照下列方法认定:<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.7pt; mso-char-indent-count: 1.98; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-size: medium; font-family: 宋体;">(一)业主人数,按照专有部分的数量计算,一个专有部分按一人计算。但建设单位尚未出售和已出售但尚未交付的部分,以及同一买受人拥有一个以上专有部分的,按一人计算;<span lang="EN-US"><br /> </span> (二)总人数,按照前项的统计总和计算。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.7pt; mso-char-indent-count: 1.98; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-size: medium; font-family: 宋体;">按照规划建设的人防工程、车库、车位、摊位等特定空间面积不计入建筑物总面积。<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.7pt; mso-char-indent-count: 1.98; line-height: 23.0pt; mso-line-height-rule: exactly; layout-grid-mode: char;"><span style="font-family: 宋体; font-size: medium;"><strong>第十八条 </strong>管理规约应当对下列主要事项作出规定:<span lang="EN-US"></span></span></p> <p class="MsoNormal" style="text-indent: 27.7pt;
